Welcome to Milwaukie Hardwoods, LLC (“Company”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our website located at https://milwaukiehardwoods.com/ (the “Site”) and your purchase of products and services from our WooCommerce online store.

By accessing our Site or making a purchase, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use this Site or purchase our items.

1. Products and the Unique Nature of Wood

1.1 Natural Variations: You acknowledge that wood is a natural material subject to variations in color, grain, texture, knots, and mineral staining. No two pieces are identical. Cracking, checking, warping, twisting, and shrinkage can occur due to changes in humidity, temperature, and environment. Milwaukie Hardwoods, LLC is not liable for natural movements of wood after it leaves our possession.

1.2 Unique and One-of-a-Kind Slabs: Many items on our Site (such as live edge slabs, burls, and tonewoods) are unique items. In rare instances, an inventory lag on our online store may result in a double sale of a one-of-a-kind piece. If this occurs, we reserve the right to cancel the transaction and issue a full refund, or offer an alternative piece of comparable value.

2. Pricing and Measurements

2.1 Board Footage (BF) & Weight Pricing: Prices are listed either per piece, per pound, or calculated by Board Footage (BF). While we make every effort to ensure accurate sizing and volume measurements on our product listings, minor variances in dimensional depth, width, or length may occur during the milling, drying, and surfacing process.

2.2 Pricing Errors: We reserve the right to refuse or cancel any orders placed for products listed at an incorrect price due to typographical errors.

3. Payment and Order Acceptance

3.1 Payment Methods: All online payments are securely processed through our WooCommerce checkout using the available payment gateways. Orders will not be prepared, milled, or shipped until full payment is cleared.

3.2 Order Acceptance: Receiving an email order confirmation does not signify our final acceptance of your order. We reserve the right at any time after receipt of your order to accept or decline it for any valid reason.

4. Shipping, Local Pickup, and Freight Delivery

4.1 Fulfillment and Processing Windows: We make every effort to process and prepare orders efficiently.

  • Standard In-Stock Items (including standard tonewoods and dimensional lumber): Orders are typically packaged and shipped, or made available for local pickup, within 3 to 5 business days from the date full payment clears.

  • Custom Orders and Specialty Services (including custom milling or custom kiln drying): Processing times vary depending on the scope of the project. Custom orders are typically completed and ready for shipment or pickup within 14 business days, unless an alternate extended timeline is explicitly agreed upon in writing at the time of purchase

4.2 Local Pickup: If you select "Local Pickup," you agree to call us at 503-309-0309 to schedule a pickup window. Items must be picked up within 14 days of purchase unless otherwise agreed in writing. Abandoned items may be subject to storage fees or re-listed without a refund.

4.3 Freight and Ground Shipping: For orders requiring freight, buyers are responsible for all shipping charges unless otherwise explicitly stated.

4.4 Delivery Liability: For freight shipments, it is the buyer's responsibility to inspect the package for damages before signing the freight carrier's release. Once you sign the carrier's release form, Milwaukie Hardwoods, LLC cannot be held liable for damages sustained during transit.

5. Returns, Refunds, and Exchanges

5.1 All Sales Are Final on Custom Orders: Any custom milling, custom dimensions, or custom-dried orders are strictly non-refundable and cannot be exchanged.

5.2 Standard Stock Returns: For non-customized tonewoods or standard dimensional lumber purchased online, returns may be accepted within 14 days of delivery. The buyer is responsible for return shipping costs. Items must be returned in their original, unaltered condition (un-cut, un-sanded, and un-finished).

5.3 Restocking Fee: Returns on large items or slabs may be subject to a 15% restocking fee.

6. Special Terms for Custom Services (Milling, Transport, Drying)

6.1 Foreign Objects in Logs: If you contract us for custom milling of your logs, you acknowledge that urban logs often contain foreign objects (nails, fencing, spikes, bullets, stones). While we inspect logs, Milwaukie Hardwoods, LLC is not responsible for damage caused to our machinery by foreign objects hidden inside your logs, and we reserve the right to charge the customer for blade replacement costs if metal is struck.

6.2 Kiln Drying Risks: Kiln drying removes moisture from wood. The intense environment can cause pre-existing internal stresses in the log to manifest as cracks, checks, or twisting. We use professional drying standards, but we do not guarantee that your wood will not warp or split during the drying process.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Milwaukie Hardwoods, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or connected with the purchase or use of our products or physical services. Our total liability to you for any claim shall not exceed the amount you paid to us for the specific product or service giving rise to the claim.

8. Governing Law

These Terms and any disputes arising out of your relationship with Milwaukie Hardwoods, LLC shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any legal actions must be filed in the courts located in Clackamas county, Oregon.
